Markets were mixed in Asia Monday. In Hong Kong, the Hang Seng Index climbed 0.6% to 20,244 and in Tokyo the Nikkei 225 Index added 0.1% to end the day at 10,205. In China, the Shanghai Composite Index fell 1.6% to 2,941. As Haiti reels from the 7.0 earthquake that devastated its capital, Port-au-Prince, on Tuesday, relief efforts are beginning to make headway. Early estimates suggest as many as 100,000 may have died, and the quake crushed the country’s fragile infrastructure and added to its monumental health-care problems. Barely a month after the world’s largest pharmaceutical company lost a case related to Wyeth’s Prempro hormone replacement therapy drug and was ordered to pay punitive damages on top of earlier compensatory damages, it lost the second pending case in the matter in Philadelphia on Monday. Initially, Pfizer was ordered in September to pay $3.75 million in compensatory damages. The punitive damages amount awarded a month later was sealed pending another verdict in a second similar case in the same courthouse. On Monday, the court revealed that Pfizer has been ordered to pay a total of $103 million in punitive damages in the two cases. The jury found the hormone drugs the two plaintiffs used for years contributed to their breast cancer. Including three other cases, so far Pfizer has been ordered to pay $165 million in punitive damages. ( AGN ) is suing the U.S. government , claiming current rules on so-called off-label drug promotion violate its First Amendment right to free speech. It wants to be allowed to “share relevant information with the medical community on the safe use” of its wrinkle-smoother Botox for off-label uses. Drugs are approved by the United States Food and Drug Administration for specific uses, but doctors are allowed to use their judgment to prescribe them for off-label uses, meaning, to treat illnesses other than the ones the FDA has approved the drug for. Pharmaceutical companies, however, are not allowed to promote such off-label uses.
